Wakaya Perfection’s lawsuit against Youngevity, initially dismissed and then revived by the Tenth Circuit Court of Appeals, has been put on hold. A federal judge in Utah granted Youngevity’s request to stay the proceedings on February 28th. The Utah case now waits for the outcome of a separate Youngevity lawsuit against Wakaya Perfection playing out in California.
Youngevity argued that Wakaya Perfection’s counterclaims in the Utah court mirrored issues already being addressed in the California litigation. The judge agreed, citing the need to avoid redundant litigation and prevent potentially contradictory rulings. This decision effectively pauses Wakaya Perfection’s claims until the California case reaches a conclusion.
If Youngevity is successful in the California lawsuit, Wakaya Perfection may get a chance to revise its Utah complaint. This could potentially reopen the Utah case, but only after the California proceedings have been resolved. The California lawsuit itself has seen few significant developments recently.
