In a sharp response filed this week, SEC attorneys called the claim "nonsense" and submitted video evidence to back it up.

The first video, posted online April 17, 2013, shows Rodrigues speaking fluent English in a promotional piece for TelexFree titled "TelexFree USA first Millionaire Sann Rodriguez Tells His Story." The SEC burned a copy to CD and submitted it to the court. "As the Court can determine by watching the video, Rodrigues has no trouble speaking English," the agency wrote.

A second video followed. On October 16, 2014, Rodrigues appeared in another promotional video for a scheme called iFreex. Though the title was in Portuguese, Rodrigues spoke English throughout. Another DVD hit the court file.

The language defense wasn't Rodrigues' only problem. He'd also claimed he needed an interpreter to understand an asset freeze order issued against him. The SEC pointed out he faced the same type of freeze back in 2006 and managed to understand and comply with it just fine.

Rodrigues cooked up the language excuse to fight contempt of court allegations. It didn't work.

The case headed to a September 30 hearing where both sides were set to square off. The matter continued into October, with Rodrigues required to file a memorandum opposing the contempt charge by October 7. The SEC got until October 14 to respond. Another hearing was scheduled for October 16.
