Instead, the court looked at Pruvit's own financial logs and found Rutherford averaged about $48,500 monthly during the baseline period. The $235,166 damage award covered what he should have earned from the trial date through the end of his original three-year settlement period.
One notable detail: Brian Underwood himself wasn't held individually liable for damages, though he clearly benefited from his 25% cut of Rutherford's commissions. The company bore the responsibility.
