Instead, the court looked at Pruvit's own financial logs and found Rutherford averaged about $48,500 monthly during the baseline period. The $235,166 damage award covered what he should have earned from the trial date through the end of his original three-year settlement period.
One notable detail: Brian Underwood himself wasn't held individually liable for damages, though he clearly benefited from his 25% cut of Rutherford's commissions. The company bore the responsibility.
The timing adds another wrinkle. In March 2025, just months after losing this case, Underwood and fellow Pruvit co-founder Terry LaCore sold the company to Herbalife. Rutherford's reinstatement of commissions now depends on whatever happens under new ownership.
