Last October, the YouTube channel Reis das Finanças published a video calling out Nui Social as a pyramid scheme. They followed up with another video in February. Both made the same claim: Nui is running an illegal scheme.
Nui's Brazilian arm didn't take the criticism lying down. Marcato Marketing LTDA, the company representing Nui in Brazil, sued Google Brazil in São Paulo court demanding the videos be removed. They wanted more than that. The lawsuit sought an injunction that would have barred Reis das Finanças from ever publishing content about Nui again. Nui also demanded that YouTube hand over the account owner's identity.
The judge wasn't impressed. In denying the request, the court found nothing wrong with the videos. "Analyzing the two videos in question, I did not verify the presence of elements of an eminently slanderous nature or that go beyond the scope of mere criticism," the judge wrote.
The ruling went further. The judge warned that removing the videos would amount to censorship. There was no urgent reason to pull them down, the court concluded.
The loss matters because it exposes Nui's vulnerability to public scrutiny in its most lucrative market. Despite being unregistered to sell securities in Brazil, the country funds a huge portion of Nui's growth. Yet Brazilian authorities have done nothing to shut it down.
That inaction stands in stark contrast to the US, where Nui has already faced securities fraud investigations in both Texas and Montana. Whether the SEC is investigating at the federal level remains unclear.
What's clear is that Nui is willing to use the courts to eliminate criticism. The Brazilian case shows the company views public exposure as a threat worth fighting in court. And it shows that at least one judge sees those legal attacks for what they are: attempts to suppress speech.
