Alex Pereira, an Empower Network affiliate since October 2012, had his YouTube account banned on February 3, 2013. Pereira used the account to upload marketing videos, which he then embedded on his "arkam77" Empower Network blog. His aim was to recruit new affiliates and build his downline.

After the ban, Pereira immediately emailed YouTube, believing his account was terminated for copyright infringement. Google's automated reply, which lacked specific details, further angered him. Pereira then posted a lengthy complaint on Google's product forums, accusing the company of disrespectful customer service. He stated that the email did not prove any copyright violation or explain the suspension's basis.

Pereira emphasized his frustration at being answered by an automated "bot," calling YouTube's customer service "shit." He argued that he had created the videos himself, using only free music from live.freeplaymusic.com, implying no infringement occurred. He viewed the automated response as a sign of Google's disregard for its users.

He warned Google that its "empire" could fall, starting with one person's dissatisfaction. Pereira demanded a human response with specific reasons and proof of any terms of use violation. He asserted that taking the time to fill out a form meant he expected a personal, detailed explanation, not a generic, automated message. He concluded by stating he was "tired of being pushed around by companies" and would pursue the matter further without a satisfactory response.

Google had not publicly responded to Pereira's forum post as of February 4th, the day after his initial complaint. The company's automated email to Pereira referenced a specific video: "I'm No Wussy Talks Internet Marketing with Rui Gabriel Part 3 – Empower Network & Lazy Millionaires." This reference suggested the termination might relate to content other than simple copyright.
