The Commodity Futures Trading Commission's (CFTC) initial legal complaint against Fundsz has been dismissed by a federal judge. U.S. District Judge John L. Berger Jr. ruled on August 31st that the complaint suffered from an "impermissible shotgun pleading." This technical dismissal means the CFTC can refile an amended complaint.

A shotgun pleading is one that fails to clearly identify specific claims against defendants, making it difficult for them to prepare a defense. Such a pleading can overwhelm the court and opposing counsel with vague allegations. Judge Berger gave the CFTC until September 8th to submit a revised filing.

The regulator sought additional time on September 7th. This request followed the unexpected death of defendant Rene Larralde, aged 51, on September 6th. The CFTC informed the court of Larralde's passing and requested an extension to determine the next steps in the case.

The court granted this motion on September 11th, pushing the deadline for the amended complaint to October 6th. The preliminary injunction previously issued in the case remains in effect. Should the CFTC fail to file an amended complaint by the new deadline, the entire case will be dismissed.

The CFTC filed its Amended Complaint on September 29th.
