Alessandra Marques of the Acre Public Prosecutor's Office confirmed a US investigation into TelexFree's operations. Speaking on Boston's "Vem Viva" radio, Marques stated that Brazilian and US governments are coordinating their efforts against the company, which faces accusations of running the largest financial pyramid scheme in Brazil.
Marques previously told reporters that Brazilian football club Botafogo could face harm by accepting sponsorship from TelexFree. The company already holds warnings in at least two other countries. Marques, who led the action that froze TelexFree assets in Brazil, noted that any funds from the Botafogo contract could be seized, even if held externally.
The US investigation focuses on TelexFree's activities in the United States. Marques described the US operation as identical to the one in Brazil. She added that the US government views Ponzi scheme perpetrators more strictly than Brazil.
Marques declined to offer specific details about the US probe. "I cannot give details, this is a sensitive issue, but an existing investigation is already happening," she stated. In a separate call with Globo, Marques named the IRS as a participant in the US investigation, alongside other unnamed regulators.
TelexFree's business model involves accepting $299 deposits from affiliates. The company promises a $20 weekly return on investment for 52 weeks. It also pays affiliates based on new deposits recruited by their downline via a matrix structure.
This structure strongly suggests the sale of unregistered securities by TelexFree. The company is registered in Marlborough, Massachusetts. Massachusetts regulators have acted against similar schemes before.
In November 2013, the Massachusetts Securities Division suspended WCM777, another alleged Ponzi scheme. WCM777 then halted its US operations and relocated to Hong Kong. The company later admitted to selling unregistered securities in the US. WCM777 recently announced a name change to Kingdom777 and stated intentions to return to the US and register with the SEC.
US regulators typically do not comment on ongoing investigations until their conclusion or if further action is taken. The confirmation of a US investigation suggests forthcoming action against TelexFree.
